SPRINGFIELD, Massachusetts — This judge will have no clowning around in his courtroom.
Massachusetts Judge Robert Murphy wasted no time denying a robbery defendant’s motion to allow him to juggle for jurors as part of his defense.
Orlando Melendez, 20, is charged with using a toy gun in the attempted robbery if a convenience store in December. He claims, however, that he was just joking around in the store and that he should be allowed to show jurors what kind of jester he is.
“The keystone to his defense is: He’s literally a clown,” the defendant, writing in the third person, explained in his motion, reported the Springfield Republican.
The judge was not amused and simply wrote “DENIED” on the motion.
Melendez has been representing himself and in the defense strategy laid out in his hand-written motion, he said he would argued that he was just clowning around in the convenience store he is accused of robbing.
He argued that if he were allowed to juggle three wads of paper for 20 seconds, jurors would understand that he is a serious clown and that the robbery was just a misunderstanding.
